Single-Use License Agreement

Effective as of: January 1, 2024

Overview

This license applies to all digital products obtained from BananaGurus (www.bananagurus.com) through the online store bananagurus.lemonsqueezy.com. It covers the usage of digitally downloadable products ("Template Files") formatted as Figma Files (.fig).

Template Usage Rights

• The “Template File” is the original item created by BananaGurus and purchased from our stores.
• With the Single-Use License, you, as the buyer, gain the right to utilize the Template File continuously on a non-exclusive basis.
• You are permitted to employ the Template File for crafting a single End Product for personal use or for a singular client (referred to as a “single application”), and the End Product may be distributed at no cost.
• The “End Product” denotes the final customized iteration or implementation of the Template File intended for personal use or sale to a client.

Permitted Actions

You are allowed to:

• Generate a single End Product for a client and transfer it to the client for a fee.
• Modify and manipulate the Template File freely. Any resulting works remain bound by this license.
• Download the Template File and host it on a different server without the requirement of attribution back to BananaGurus. The Single-Use License remains applicable to the Template File, irrespective of its hosting location.

Limitations

However, you cannot:

• Sell the Template File or any modified version to more than one client. Additionally, your client is restricted from reselling the End Product.
• Integrate the Template File into a work intended for redistribution or resale, either by you or your client. Redistribution, whether free or for resale, of the Template File in its original state or after alterations, is not allowed.
• Extract a single component from a Template File for use beyond the scope of the End Product.
• Allow the client or end user of the End Product to extract a single component from the Template File for use beyond the scope of the End Product.

Ownership and Enforcement

• BananaGurus, as the creator of the Template File, retains ownership. This license is a mutual agreement between BananaGurus and you. Lemon Squeezy, LLC, the payment facilitator, is not a party to this license.
• In case of a license breach, BananaGurus reserves the right to take legal action.

Template File Terms of Use

Additional License Considerations

In the case of Template Files, various components of the item may be obtained by BananaGurus from external sources, each subject to different license terms, such as licenses from other creators, open source licenses, or creative commons licenses. If such components exist, BananaGurus will clearly identify them on the Item's licenses page. The alternative license will exclusively apply to that specific component, replacing the terms of this license for that component only. The terms of this license will continue to apply to the remaining portions of the Template File.

Partners

Our partner Lemon Squeezy, LLC (https://lemonsqueezy.com) handle the payment processing and transaction facilitation. By acquiring a Template File through our partner, you agree to adhere to the BananaGurus Terms of Service.

Template Availability

• BananaGurus cannot guarantee the ongoing availability of a specific template, whether free or paid, for additional purchases or downloads.
• Templates featured in the online store are subject to potential deletion or modification by BananaGurus at any given time.

Support

• Technical support for a Figma File cannot be provided by BananaGurus.
• Limited technical support may be provided at BananaGurus’s discretion to a Template File purchaser. Proof of Purchase is required.
• Template Files may undergo updates to enhance design or functionality, allowing you to re-download the updated Template File for a single End Product.

Intellectual Property

• Templates containing graphics of real products, trademarks, or other intellectual property not released by BananaGurus are licensed for editorial use only. It is your responsibility to obtain clearance from the respective intellectual property rights owner if needed.
• While BananaGurus, as the creator of the Template File, retains ownership, a license is granted to you under the terms of this Single-Use License. This licensing agreement is established between BananaGurus and you, with Lemon Squeezy, LLC not being a party to or providing the license.

Refunds

• Due to the digital nature, BananaGurus does not routinely offer refunds.
• Refunds, at the discretion of BananaGurus, may be considered on a case-by-case basis.

Limitation of Liability

The Template Files and all BananaGurus intellectual property are provided on an "As is" and “as available” basis, without any expressed or implied warranty, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currentness, freedom from interruption, viruses, or other defects, and non-infringement.

Your sole recourse, if dissatisfied with the template file or any BananaGurus intellectual property, is to cease using the product, service, or any related BananaGurus intellectual property. In no event shall BananaGurus, our affiliates, subsidiaries, officers, directors, employees, agents, licensors, or service providers be liable for any damages, whether indirect, consequential, special, incidental, or punitive, arising from the use or inability to use the service or the BananaGurus intellectual property. Such damages may result from warranty, contract, tort, or any other legal theory, regardless of whether we or our affiliates have been advised of the possibility of such damages.

To the maximum extent allowed by applicable law, BananaGurus assumes no liability for any (i) errors, mistakes, or inaccuracies in BananaGurus intellectual property; (ii) personal injury or property damage resulting from your access to or use of the template file; (iii) unauthorized access to or use of our secure servers and/or any information stored therein; (iv) errors, mistakes, losses, damage, or unauthorized access resulting from the use of third-party applications by you, your end users, or BananaGurus on your behalf; (v) interruption or cessation of transmission to or from any BananaGurus service; (vi) bugs, viruses, trojan horses, or similar transmitted through our products or services by any third party; (vii) errors or omissions in any BananaGurus intellectual property or for any loss or damage incurred as a result of the use of any BananaGurus intellectual property posted, emailed, transmitted, or otherwise made available through the template file; and/or (viii) user content or the defamatory, offensive, or illegal conduct of any third party. In no event shall BananaGurus, its affiliates, agents, directors, employees, suppliers, or licensors be liable to you for any claims, proceedings, liabilities, obligations, damages, losses, or costs related to this agreement in an amount exceeding $100.

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if BananaGurus has been advised of the possibility of such damage. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction and will apply regardless of the success or effectiveness of other remedies.

By purchasing, downloading, opening, or otherwise using a BananaGurus template file, whether obtained from our shop, purchased via one of our partners, or acquired elsewhere it is offered, you agree to these terms and to BananaGurus’s Terms of Service.
